What is the ELP Requirement?

Under 49 CFR §391.11(b)(2), every commercial motor vehicle driver must be able to read and speak the English language sufficiently to converse with the general public, understand highway traffic signs and signals, respond to official inquiries, and make entries on reports and records.

This regulation applies to all CMV drivers operating in interstate commerce, regardless of their country of origin or primary language. Enforcement has increased significantly in recent years, with FMCSA making ELP a priority during roadside inspections.

Enforcement Alert

ELP violations result in an Out-of-Service order, meaning the driver is immediately placed out of service and cannot operate the vehicle until the violation is resolved.

The Two-Step ELP Assessment

During roadside inspections, federal inspectors conduct a two-step ELP assessment:

Driver Interview

The inspector gauges the driver's ability to respond to official inquiries in English, including questions about their route, cargo, and operating authority.

Sign Recognition Test

The inspector presents images of common U.S. highway traffic signs and signals, verifying the driver can correctly identify and explain their meaning.
